NEW EA OFFER FOR CONSIDERATION

A new offer to UFUSA members employed as firefighters by the SAMFS has now been received in writing and will be considered by your Shop Stewards and State Councillors at a meeting at the union office at 11:00 hours today.

Made on a “without prejudice” basis, the offer has been made by the employer as a total package offer in full settlement of all claims for a new South Australian Metropolitan Fire Service Enterprise Agreement 2022 (EA).

The Industrial Relations and Policy Branch (IRAP), of the Attorney-General’s Department, on behalf of the declared employer (Fair Work Act 1994), advises that it reserves the right to vary, withdraw or correct any unintended aspect of this Offer. The Offer is subject to the finalisation of formal terms of a new SAMFS EA 2022, acceptance, and requisite approval by the South Australian Employment Tribunal (SAET) pursuant to the Fair Work Act 1994.

PERIOD OF AGREEMENT

Under this offer a new SAMFS EA 2022 will come into effect on and from the date of approval by SAET with an expiry date of 1 January 2025. If accepted, dependent upon the SAET certification, the new EA would have a life of two years. Negotiations for a new enterprise agreement will commence no later than six months prior to the expiry date.

WAGES

Backpay – the offer includes annual wage increases comprised of:
2.5% from the first full pay period commencing on or after 1 January 2021;
2.5% from the first full pay period commencing on or after 1 January 2022
3% per annum wage increases operative from the first full pay period commencing on or after:
1 January 2023
1 January 2024
1 January 2025 (at the expiry of the EA)

ONE-OFF PAYMENT

The offer “includes a one-off payment of $1,500 — for employees (other than casuals) subject to conditions and criteria, including pro rata for part-time and Retained Firefighters and temporary/term contract employees, payment will not count for any other purpose whatsoever, applicable date of employment for eligibility, employee acceptance of this Offer and approval by the SAET of the new agreement, and payable as soon as reasonably practicable (preferably within 3 months) after approval by the SAET.”

INDUSTRIAL ISSUES

A number of industrial issues under dispute would also be addressed by the offer with an amendment to the clause 31 Senior Firefighters Level 2 Qualified, of the SAMFS EA 2017, to address skill and training requirements in light of SAET proceedings ET-21-05072 in 2021.

A Review of Clause 24.10 – Fire Cause Investigation will be conducted within the first three months of the life of the new agreement and subject to agreement between the parties, the outcome of the review may form part of the agreement, by way of a consent variation.

AMBULANCE ASSIST

The offer seeks the inclusion of a clause confirming the UFU’s participation in the Premier’s Taskforce acknowledging the UFU’s participation in the Premier’s taskforce on Ambulance Assist.

Please note: it has been clarified that this proposal recognises that the Taskforce is addressing the escalation of ambulance assist calls being experienced by firefighters and the issues arising, and does NOT constitute agreement to First Responder nor is that sought in this offer.

SEPARATE FROM THE ENTERPRISE AGREEMENT

It is proposed that a review will be conducted by an agreed independent person into

  • The promotions process at the SAMFS for the rank of Station Officer and Commander within the first 12 months after the date of SAET approval of a new SAMFS EA 2022; and
  • Regional SAMFS Stations, including payment of incentives to employees to work at such stations, within six (6) months after the date of SAET approval of a new SAMFS EA 2022.

The performance of employer commitments from the EA 2017 which have been either not delivered or reneged upon, has been required. These involve staffing of the Engineering Department and the provision of Galatea jackets to all recruit squads from January 2018.

Feedback from members has indicated that while such an offer is modest in the current economic environment it is worthy of your consideration.

No offer is or will be accepted without the majority accepting it through a full ballot.
